Zoeller Wants Court to Clarify Healthcare Law
October 10,2013 — During a visit to Gary today Indiana’s Attorney General spoke about a major lawsuit he filed this week.
Greg Zoeller told Lakeshore News that the lawsuit filed by his office on behalf of fifteen Indiana schools is intended to clarify whether or not the Internal Revenue Service has the right to tax states as employers.
Under the Affordable Care Act public schools, like other employers, would face a penalty from the IRS if they do not provide insurance coverage to full time employees.
Zoeller says the state and federal government have had a practice of not taxing each other in the past.
Zoeller says the suit is asking for a declaratory judgment which would interpret and clarify the language of the Affordable Care Act.
