Ramirez Murder Case Gets Indiana Supreme Court Appeal
October 1, 2013 — A Lake County murder conviction has its appeal this week at the Indiana Supreme Court. The case set for Thursday’s oral arguments is Ernesto R. Ramirez v. State of Indiana.
The Indiana Supreme Court says the appeal started when Lake Superior Court released a juror from service, and Ramirez moved for a mistrial on the grounds that the jury had been “tainted.”
The trial court denied the motion for mistrial, and Ramirez was convicted of murder and criminal gang activity.
Court records say the Court of Appeals affirmed that trial and its conviction in a memorandum decision.
The Indiana Supreme Court granted a petition to transfer the case and assumed jurisdiction over the appeal.
