Porter County School Among New Plaintiffs

December 9, 2013 — A Porter County School Corporation is among 24 school districts joining a lawsuit challenging the nation’s Affordable Care Act.

Today, state Attorney General Greg Zoeller said they join 15 other Indiana school districts who filed a lawsuit in October.

East Porter County School Corporation is one of 39 schools, and the State, who say the federal government, through the Internal Revenue Service, exceeded its legal authority under the act.  They say an IRS rule is illegal because it charges financial penalties against large employers who do not offer health insurance to employees working more than 30 hours per week as full-time workers.

The lawsuit also argues penalties can’t be applied to government employers because the Tenth Amendment says the federal government cannot tax a state agency.
