The Indiana Supreme Court unanimously upheld merit selection for judges.  The high court decision now prohibits Lake County Superior Court Judge Nicholas Schiralli from taking the position vacated by former Juvenile Judge Mary Beth Bonaventura.  Bonaventura left the bench to become the newest director of the Indiana Department of Child and Family Services.

The Supreme Court unanimously held that only judges who were selected by the merit process may transfer from one court to another in Lake County.  Judge Schiralli was already a judge of the Lake County Court when the merit selection process was adopted.

Indiana Attorney General Greg Zoeller said in a statement issued Friday that the Justices’ decision underscores the important state public policy behind the merit selection process.

It isn’t immediately known if any of the other Superior Court judges want to move onto the juvenile court bench.
