Foul Ball Case Going to State Supreme Court

A lawsuit involving a foul ball is going to the state Supreme Court next month.

The Indiana Supreme Court has set January 9, 2014 for arguments in the case of South Shore Baseball LLC v. Juanita DeJesus.

Court records show the case involves a spectator, injured by a foul ball during a professional baseball game, who sued the ballpark operator for premises liability and negligence.

The state’s high court took the case after the Lake Superior Court denied the operator’s motion for summary judgment, or dismissal, though the Court of Appeals ruled that the operator is entitled to summary judgment.  (South Shore Baseball v. DeJesus Appellate ruling)
